The recent ruling by the Supreme Court which stated that reservation shouldnot extend to the creamy layer of the Scheduled Casts and Scheduled Tribes has invited rather sharp reactions from the political community, some of them are as follows:
"The Supreme Court has taken a decision. We have to study it and then we will act."

"The Constitution has no provision for creamy layer within the Scheduled Tribes and Castes precisely because of the compelling realities of their socio-economic oppression and exploitation. It is unfortunate that the court has ignored the social reality while pronouncing judgement on such a vital issue."

PMK on Friday said the Supreme Court's judgment that the "creamy layer" should be excluded from the reservations for the scheduled castes and scheduled tribes in government jobs, would crush the concept of reservation and hence steps should be taken to get it modified.
Whoa!!!!!!! Seems like the survival of the Scheduled Casts and Tribes is at stake. Or is it the other way around? Is it these very politicians who are shit scared because of the Assembly Elections around the corner? Well as far as i am concerned its the second option.
Lets try and analye the situation. For starters lets look at the Supreme Courts observations : "It is made clear that even if the state has compelling reasons, the state will have to see that its reservation provision does not lead to excessiveness so as to breach the ceiling limit of 50 per cent or obliterate the creamy layer of extended reservation indefinitely." So what you may say, thats what this is all supposed to be about? Right? Right? No wrong.
Its not about that at all. It all comes down to a very simple thing, votebanks. What is Reservation supposed to be about anyways? Helping the downtrodden reach a level that is at par with the majority, it is about giving people a chance to compete on an even keel. And the Supreme Court maintaining its status as the sole voice of sanity left in the Indian judiciary or the Administration for that matter, stated that reservations for people who no longer need them should be stopped. That will help free up resources that can help people who acatually need them. But this is not even feasible as is demonstrated by all these parties ganging up against this very idea. And this is not actually the worse that can happen Sharad Yadav is even against the idea of "judicial interference" and wants the constitution to be so modified that the Supreme Court cannot pass judgements on such issues.
Again its astonishing that crap like this gets accepted without even a debate. Nobody seems to have a problem. Thats the saddest part.
So, what do we do? Sit and ponder i guess or maybe write blogs about it. Thats all we have always done. Cant expect much.
